Payment authorization

When you submit an order and authorize payment, you authorize coolcontacts to charge the payment method selected at checkout for the amount shown in your order. You represent that you are authorized to use the selected payment method and that the billing and order information you provide is accurate and complete.

You are responsible for ensuring that the selected payment method can cover the purchase amount. Payment information is processed through the payment services available at checkout and is subject to the applicable provider's security and processing requirements.

Order acceptance

Submitting an order is an offer to purchase and does not guarantee acceptance. An order confirmation acknowledges that we received your order; it does not by itself constitute acceptance of the order. Before shipment, coolcontacts may refuse, limit, or cancel an order, in whole or in part, at its discretion, including for payment, availability, pricing or listing errors, suspected fraud or misuse, shipping restrictions, regulatory requirements, or order-verification reasons. If we cancel an order after payment has been captured, we will refund the amount charged for the cancelled portion.

Pricing and listing errors

We make reasonable efforts to keep product descriptions, availability, and prices accurate. If an error affects an order, coolcontacts may correct the error and, before shipment, cancel the affected item or order and refund any amount already charged for it.

Refunds and disputes

Refund and return eligibility is governed by our Shipping & Returns policy. If you believe there is a problem with a charge or order, please contact us so we can review it. Nothing in this section limits any chargeback, cancellation, refund, or other right available to you under applicable law.

Use of the site

You may use coolcontacts.ca only for lawful personal or commercial shopping purposes. You may not use the site to upload, publish, reproduce, transmit, distribute, access, or otherwise engage in activity that:

• violates applicable law or encourages unlawful conduct;
• infringes copyright, trademark, privacy, or other rights of coolcontacts or any third party;
• contains malicious code, viruses, worms, Trojan horses, or other harmful or disruptive components;
• interferes with, disrupts, damages, probes, circumvents, or attempts to gain unauthorized access to the site, its systems, accounts, security features, or data;
• uses automated means to scrape, harvest, copy, or extract site content or data except with our prior written permission or as permitted by law; or
• misrepresents your identity, payment authority, or the purpose of a transaction.

You are responsible for activity conducted through any customer account or credentials under your control and for keeping your login information confidential.

Trademarks

The coolcontacts name, coolcontacts.ca, logos, product names, and other marks displayed on the site may be registered or unregistered trademarks of coolcontacts or their respective owners. Nothing on this site grants a licence or right to use a trademark without prior permission from the applicable owner.

Product use and safety

Contact lenses are medical devices and must be used, handled, cleaned, stored, and replaced in accordance with the product instructions, labelling, applicable care guidance, and the advice of your eye-care professional.

You are responsible for determining, in consultation with a qualified eye-care professional where appropriate, whether contact lenses are suitable for your eyes and for obtaining any examination, fitting, prescription, or professional advice appropriate to your circumstances. You should not purchase or use contact lenses if an eye-care professional has advised you not to wear them. coolcontacts does not determine whether a particular lens is medically appropriate or properly fitted for an individual customer.

You are responsible for following all product instructions, labelling, wear limits, replacement schedules, care requirements, and the advice of your eye-care professional. Information on coolcontacts.ca is provided for general product and educational purposes and is not a substitute for individualized medical advice, diagnosis, fitting, or treatment.

Nothing in this section excludes or limits any responsibility or liability of coolcontacts that cannot lawfully be excluded or limited.

Site availability and information

To the maximum extent permitted by law, coolcontacts.ca and its site content are provided on an "as available" basis. We do not guarantee that the site will always be uninterrupted, error-free, secure, or free from technical problems, or that every description, image, compatibility statement, availability status, or other site detail will always be complete or current. If you are dissatisfied with the site, your remedy in relation to use of the site itself is to discontinue using it, except for any right or remedy that cannot lawfully be excluded or limited.

Limitation of liability

To the maximum extent permitted by applicable law, coolcontacts and its owners, directors, officers, employees, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or business opportunity, arising from or related to your use of, or inability to use, the site or a transaction through the site.

Where liability cannot lawfully be excluded but may lawfully be limited, the aggregate liability of coolcontacts arising from a particular order will not exceed the amount you paid to coolcontacts for the product or order giving rise to the claim. Nothing in these terms excludes or limits liability, statutory warranties, or consumer rights to the extent that applicable law prohibits their exclusion or limitation.

Indemnity

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless coolcontacts and its owners, directors, officers, employees, agents, affiliates, and service providers from claims, liabilities, losses, damages, costs, and reasonable legal fees arising from or related to your material breach of these terms, unlawful or unauthorized use of the site, infringement of another person's rights, fraudulent or misleading activity, or misuse of an account or payment method under your control.

Site administration and enforcement

coolcontacts may, where reasonably necessary to protect the site, its customers, or its business, investigate activity, restrict or suspend access, refuse transactions, preserve relevant records, and remove or restrict content or activity that we reasonably believe is unlawful, harmful, fraudulent, abusive, infringing, disruptive, or contrary to these terms. We may disclose information where required or permitted by applicable law and in accordance with our privacy obligations.

Entire agreement, waiver, and severability

These Terms & Conditions, together with the policies and documents expressly referenced here, form the agreement between you and coolcontacts concerning your use of this site and purchases made through it. A failure or delay by coolcontacts in enforcing a provision does not waive that provision or any other right, and a waiver in one instance does not constitute a continuing waiver.

If a court of competent jurisdiction determines that any provision is invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where possible, and the remaining provisions will continue in effect.

Changes to these terms

coolcontacts may update these Terms & Conditions from time to time. Changes take effect when posted to this page and apply prospectively. An order is governed by the terms in effect when the order is submitted, subject to any change required by applicable law.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, subject to any mandatory consumer-protection law that applies to you and cannot lawfully be excluded by agreement.
